Gay rights around the world

Developing of gay rights is strict connected with the level of Democracy. If countries recpect Political Rights, and Civil Liberties, those countries generaly also respect Gay Rights. High economic development of country has big meaning also. If the country is rich, than communities are more open, and tolerant for Gays, and thay Rights.
On the other hand, in lower development countries, homosexuality is subject to penality, by fine, prison, and even by deth. It's negative influence give religion also, mainly islam. The prohibition of homosexual acts, are in most countries the "postcolonial relict", after decay of great world-power. Becouse communities in those countries are generaly poor, so thay are more conservative and religious. It makes difficult abolishing of this law.
So there is big difference on Gay Rights from country to country. From full equalisation in the Netherlands, by same-sex marriage, to deth penalty in Saudi Arabia. The proces of Gay emancipation is the global issiue. Gay Rights are developing generaly in most countries from America to Oceania. Even if Gay Rights are developing worldwide, there are some countries witch back in this proces. For example Russia, or Belarus witch consider to recriminalise gay sex. Belarus even by deth penalty.
There must be done four steps in proces of gay emancipation:
- Homosexuality must be legalised – completely or just in private.
- Abolish all discriminatory provisions in law – like acces to Military Service, equalisation age of consent, remove ban on "public manifestation their sexual orientation" itc.
- introduction of protection in law based on sexual orientation – antidiscrimination law, can exist in:
- The Constitution,
- Penal Code,
- Labour Code,
- and in many oters Acts.
- guarantee asylum right also based on sexual orientation.
- recognition of same-sex couples: this law can have five types:
- Civil Marriage, or same-sex marriage – it give all the same rights and responsibilities as opposite-sex marrige. (e.g. Belgium.)
- Registered Partneship – it is Scandinavian model, giving near all the same rights and responsibilities as marriage with some exeptions, like adoption right, and use differet name, include wedding ceremony. (e.g. Norway)
- Civil Unions – it give registered partners just part of rights and responsibilities similar to marriage, exclude wedding ceremony. (e.g.France)
- Unregistered Cohabitation – it give just some of rights and responsibilities similar to marriage, for informal cohabiting same-sex couples. Wedding ceremony are not performed. (e.g.Portugal)
- Domestic Partnership – it give just several rights for cohabiting same-sex couples. In most, thay are result of court decisions in those cases. Like adoption right, imigration right, government pension itc. (e.g. Israel)
Exept of those five types of recognition of same-sex couples, there where some individual cases, when court recognised some right to same-sex partner. e.g. The court in Mexico recognised lesbian right to compensation, after her lesbian partner die in 2005.
