Delfino v. Moore
Cameron Alden Moore is a convicted federal criminal and former employee of Agilent Technologies in Colorado. Moore was arrested by the FBI for using the Internet at work to threaten to harm Michelangelo Delfino and Mary E. Day, two free speech activists in California.
After Moore's conviction, Delfino and Day inititated a civil lawsuit against Moore in California's Santa Clara County Superior Court. Defendant Moore filed a cross-complaint alleging defamation by libel and slander, vexatious litigation, fraud and other torts. Delfino and Day responded with a special motion to strike and on January 20, 2004 Moore's cross-complaint was stricken as a SLAPP.
Depositions and written discovery followed and after a court trial on April 18, 2005 damages were awarded Delfino and Day for the intentional infliction of emotional distress as follows: $87,323.00 collectively to both plaintiffs; $200,000.00 to each plaintiff for general damages; and $300,000.00 to each plaintiff for punitive damages. The next day Delfino and Day filed a memorandum of costs in the amount $12,780.94, which the trial judge also approved.
